We are buying a house and the seller did not provide the Property Transfer Lead Paint Notification form before signing the P&S.

ADDITIONAL INFORMATION:

This is a a clear violation of MA law and Federal law.  Can this be used as a negotiating point to lower the sale price?

ATTORNEY ANSWER:

Probably not. The expenses involved in trying to obtain any reduction in the sales price would most likely not be justified; however you ask a good question.

Seller of property refuses to meet closing dates.

ADDITIONAL INFORMATION:

I have spent so much time and money on this and the sellers are just refusing to actually sell this house. Can they do this?  What are my legal rights?

ATTORNEY ANSWER:

The way to handle a closing date problem is to provide the Seller with a notice preferably by certified mail or delivered by a process server that if they fail to agree upon a new closing date within a certain period of time that you would seek the assistance of a Court by filing a lawsuit.
